What is Ayewind?

Welcome to Ayewind ! This is the brand-new platform for artists to share their work in a space dedicated to growing talent. Aside from sharing your work, our platform is designed to give artists the space to work together, forming partnerships to create bigger and better projects.

Aside from that, Artists and Animators now can sell their Artworks and Videos on Ayewind through Royalty Free license. Artists will always own their copyright and can sell their work multiple times through the platform !

We aim to provide a platform that helps artists and professionals find new clients, share their work easily across the web, and build an audience online.

How It Works

It’s easy to get started on Ayewind. You can create a profile for free and instantly upload your artwork. Others can view your art, follow your profile, and share your creations to others.

On our Project page, you can contact other artists and creators to work together on an upcoming project. Are you in need of an animator that can help you create fun videos for your brand? Do you need an illustrator to make you a book or album cover? Or maybe you need a creative that can make explainer videos that catch people’s eyes? Ayewind collates talent from across the web into an easy-to-use platform.

Thanks to the built-in private messaging system and category system, it’s simple for recruiters to find your profile and send you a message. We hope that Ayewind will become the leading platform for finding talent from across the planet.

Ayewind is currently still in its Beta stage, but as it continues to grow, we hope to be able to offer monetizations and other perks to our members the future. To get there, we need you - artists and art-lovers.

Ayewind Medal System

Ayewind has a built-in rating system determined by a variety of different factors - we call this the Medal System. Each media has a unique rating that influences the media’s appearance in the search results: the better the rating the more likely the media is to appear on the first page.

What Determines A Media’s Rating?

A media’s medal rating is determined by viewer rating, the number of views, likes and comments, and the relevance of the media in its set category. While all of these statistics will be available to creators who use Ayewind, we wanted to create a simple rating system that highlights a media’s success.

creators will be able to see a collated form of all their profile’s statistics, including their overall rank and the performance of their best medias. This is a system designed to reward popular medias and their creators.

Quality Creators, Quality Animation

We want Ayewind to be the premier location to source, watch and show-off quality animation on the web. That means we have to maintain a certain level of quality. This Medal System helps us to achieve just that.

medias which hit a low threshold will likely be put under review by our team. If they don’t match up to our quality control, they’ll be removed from the website.

Battle For Medal Score

Ayewind will feature a battle system. Two medias will be pitted up against each other for a viewer to decide which media they preer. This is an anonymous system where just the animated media (from the same category) is displayed to a viewer.

The medias which receive a positive vote will earn some extra Medal Score, while the medias that lose will miss out on potential score. This is a fun way for viewers to interact with creator’s medias and to give all medias a chance to appear on the site.

The Number To Beat

To further reward those who have successful medias on Ayewind, we’ve set a “Number To Beat”. This is the upper threshold for a popular media on the site in terms of its Medal Score. Beat this number and you’ll receive special perks and rewards that can help to improve your profile. This number will be constantly updated to reflect the community - you will be able to find it on the homepage.

Ayewind Affiliate Program

Building an audience for your work is never easy, especially when competition is tight and the internet awash with creative people .

Here at Ayewind it’s our goal to provide a unique platform that accelerates the growth of new creators and helps those with an already established audience branch out in different directions.

While many creators choose to upload their work to platforms such as YouTube, there is not much space for the multitude of animations: practical medias, animations for business, and medias for education, for example.

Introducing the Ayewind Affiliate Program. This is our way of giving back to the community on Ayewind. You can earn income from your animation medias, and it’s very straight-forward.

Earn Money On Ayewind With Views

Ayewind affiliates earn on their animated medias depending on the number of views reached. This is a fixed-rate and the same for every affiliate. This is a simple method to earn money from your medias, and it takes the hassle out of confusing SEO terms and CTR.

The way our affiliate system works is simple:

You earn for the views on your animated medias.

The way we see it, the first 5,000 views are more valuable than the views after 5,000, at least to begin with. This gives every animator an opportunity to get paid for their medias.

Each affiliate will be able to view all the data on their medias via their Ayewind dashboard. This will include information like the rate of viewership, the number of unique views per media, and how much you’ve earned from that month of viewers.

Build An Audience

Your Ayewind profile is designed to be the focal point of your animated work on the web. We hope we’re able to provide all the tools you need to effectively run a business off our platform, and build an audience with ease.

Thanks to our frequent competitions, featured medias and highlighted creators, your work will get attention on Ayewind. You can also introduce current followers to your new Ayewind portfolio to get a head start.

Affiliate Eligibility

Ayewind is still in its early stages, and the criteria for affiliate reflect that. This checklist is likely to change as the website grows in popularity, but earn your position now and you’re guaranteed the role no matter how large the website grows.

  • At least ONE media uploaded on Ayewind that reaches 1,000 views
  • Attract at least 30 followers to your Ayewind profile
  • Content that conforms to our Community Guidelines and Terms of Service

Please note, these achievements are the minimum requirements for us to consider granting the affiliate role. Completing them does not guarantee Partnership with Ayewind.

Please note, we are still in the early stages of the Ayewind Affiliate Program and therefore we can’t accept all applications. We have also established a maximum earning threshold during these early stages of Ayewind. This will change in time as the website and program grows in size and scope.

Who owns the copyright of the images on Ayewind ?

Every illustration on Ayewind belongs to the artist or the creator of the image. Only artists have the copyrights of royalty-free images and they give the ‘rights to use the image’ to the buyers.

The image’s copyright remains with the owner and only the license for appropriate use of the image is transferred to the buyer. Ayewind acts as a broker between the copyright owner of the image and buyers.

Artists receive a percentage of the price when someone buys the right to use the artwork. They make money from selling the image’s license to many buyers at the same price or variable price according to their free will.

Benefits of Royalty-Free Images :

Royalty-free images have gained tremendous popularity because they are cheap, instantly available and easy to license. If you like an image from the Ayewind’s gallery that you would like to use commercially, you can purchase it for one fixed price and have the lifetime right to use it.

Many stock websites sell short-term image licenses, and when the period is over, you have to track down the artist who has the copyright and renew the license by paying again. This process is not only complicated but quite risky

Fortunately, the royalty-free images are more practical, free of legal implications and don’t require you to renew the license again and again.

Royalty-free means that after the upfront payment, you have the right to use the image for numerous purposes without any time limits.

Artists also benefit from royalty-free images when they receive a percentage of the price, every time the license is sold to a new buyer.

The royalty-free image licensing ensures plenty of benefits for both parties; artists and buyers.

Rights and Restrictions

Lot of people think royalty-free images once licensed can be used any way you want. This is not true. Although you have the right to use them, you are not the owner of the image, you only have the right to use the image as long as you follow the rights and restrictions below:

  • Frequency and Duration. You can use the royalty-free images as many times as you want and for as long as you want.
  • Non-transferable. The royalty-free images that you license are in your name. The license cannot be transferred, resold, or gifted to someone else.
  • Geographical-Use. Images can be used anywhere in the world.
  • Credits. Giving credits to the copyright owner is not mandatory.
  • Usage. You can use the images in print media, social media, websites, and all types of advertisements. They can be used everywhere, except the restricted places that are mentioned in the license agreement.
  • Non-Exclusive Rights. The royalty-free images are sold to numerous individuals who pay for them, and they all have a general license. If you want to have more rights, such as the right to resell or produce copies, you will have to purchase an extended or exclusive license.
  • Restrictions

    • You cannot share the image with others for further use, similarly, the picture cannot be shared on a network, intranet, or shared access drive or sold to a third party
    • Use of royalty-free images in creating content related to sensitive topics such as politics, gender, and religion is prohibited
    • You cannot portray the model or property in the image to be endorsing a service or product.
    • The image cannot be used in pornographic or sexually explicit content.
    • The royalty-free image cannot put the model or properties shown in the image in a negative, offensive, obscene, discriminatory, or morally questionable position.
    • The image cannot be a part of a logo or trademark, because the copyright does not belong to you.

    The images on Ayewind are sold with a commercial royalty-free image license. Unlike editorial license, which restricts the use of images in marketing and advertising, royalty-free images from Ayewind can be used for a wide variety of purposes:

    • Websites.Most websites use visually appealing and high-quality royalty-free images to engage users.
    • Blogs.Bloggers use royalty-free images in their blogs to clarify, teach, and tell a story just like words do. Readers not only relate to the words of the blogs but also the images that are used to signify the topic
    • Social Media.Royalty-free images are printed on the covers of books, magazines, and other products.
    • Covers.Royalty-free images are printed on the covers of books, magazines, and other products.
    • Creative Projects.Graphic designers and artists can use royalty-free images in artistic and creative projects such as banners, business cards, e-books, and presentations.
    • Print Designs.Royalty-free images are printed on t-shirts, cups, bags, and other products.

    About Us

    AYEWIND Ltd address: Kristinehöjdsgatan 3, Göteborg, Sweden (hereafter referred to as "the Platform", "we", "us", or "our") provides an platform where artists can upload images and customers can purchase certain licensing rights to use those images (the “Services” or the “Platform”).

    The Services are accessible at Ayewind.com and any other websites through which the Platform makes the Services available (collectively, the “Site”).

    Your access and use of the Site constitute your agreement to comply with and be legally bound by the terms and conditions of these Terms of Service ("Terms"), whether or not you become a registered user of the Services.

    These Terms govern your access to and use of the Site and Services and all Collective Content (defined below), and constitute a binding legal agreement between you and the Platform.

    If you are not acting on a personal account and you accept or agree to these Terms on behalf of a company or other legal entity, you represent and warrant that you have the authority to bind that company or other legal entity to these Terms and, in such event, “you” and “your” will refer and apply to that company or other legal entity.

    If you do not agree to these Terms, you have no right to obtain services from or otherwise continue using the Site. Failure to use the Site in accordance with these Terms may subject you to civil and criminal penalties.

    Definitions

    • Artist means a user that post an image to the Platform.
    • the Platform Content. means all Content that the Platform makes available through the Site, or Services, including any Content licensed from a third party, but excluding Member Content.
    • Collective Content . means Member Content and the Platform Content.
    • Content means any and all text, graphics, images, music, software, audio, video, information or other materials.
    • Customer means a Member who browses and buys image rights from an Artist via the Platform.
    • Member means a person who completes our account registration process, as described under “Account Registration” below.
    • Member Content means a person who completes our account registration process, as described under “Account Registration” below.

    Modification

    the Platform reserves the right, at its sole discretion, to modify the Site or Services or to modify these Terms, at any time and without prior notice. If we modify these Terms, we will post the modification on the Site or provide you with notice of the modification.

    By continuing to access or use the Site or Services after we have posted a modification on the Site or have provided you with notice of a modification, you are confirming that you agree to be bound by the modified Terms. If the modified Terms are not acceptable to you, your only recourse is to cease using the Site and Services.

    You may view the Site as an unregistered visitor to the Site and Services; however, if you wish to post an image or buy an image, you must first register to create an Account (defined below).

    The Platform cannot and does not control the Member Content as such we cannot guarantee that Member Content is accurate, true or correct in any way. The Platform is not responsible for and disclaims any and all liability related to any connection between the Members on the Site. Accordingly, any connection will be made at your own risk.

    Account Registration

    In order to access the Services on the Site, you must register to create an account (“the Platform Account”) and become a Member of the Platform. You may register to join the Services directly via the Site by completing a form and choose either a Customer Account or Artist Account.

    All registrations are free, but we reserve the right to start charging at anytime in the future.

    Although we have no responsibility or duty to check the information you upload to our Site, you agree to provide accurate, legal and complete information during the registration process and to update such information to keep it accurate, current and complete. The Platform reserves the right to suspend or terminate your Platform Account and your access to the Site and Services if any information provided during the registration process or thereafter proves to be inaccurate, illegal or incomplete

    You are responsible for safeguarding your password and agree that you will not disclose your password to any third party and that you will take sole responsibility for any activities or actions under your Platform Account, whether or not you have authorised such activities or actions. You will immediately notify the Platform of any unauthorised use of your Platform Account

    User Conduct

    You understand and agree that you are solely responsible for compliance with any and all laws, rules and regulations, that may apply to your use of the Site, Services and Content. In connection with your use of our Site and Services, you may not and you agree that you will not:

    • violate any local or other law or regulation, or any order of a court.
    • use manual or automated software, devices, scripts robots, other means or processes to access, “scrape,” “crawl” or “spider” any web pages or other services contained in the Site, Services or Content.
    • use the Site or Services for any commercial or other purposes that are not expressly permitted by these Terms
    • copy, store or otherwise access any information contained on the Site, Services or Content for purposes not expressly permitted by these Terms.
    • infringe the rights of any person or entity, including but not limited to, their intellectual property, privacy, publicity or contractual rights.

    • "stalk" or otherwise harass in any way any other user of our Site, or Services or collect or store any personally identifiable information about any other user
    • register for more than one the Platform Account or register for a the Platform Account on behalf of an individual other than yourself
    • when acting as a Customer or otherwise, recruit or otherwise solicit any Designer or other Member to perform services outside these Terms or join third party services or websites that are competitive to the Platform
    • impersonate any person or entity, or falsify or otherwise misrepresent yourself or your affiliation with any person or entity
    • use automated scripts to collect information or otherwise interact with the Site or Services
    • or post, upload, publish, submit or transmit any Content that
      • infringes, misappropriates or violates a third party’s patent, copyright, trademark, trade secret, moral rights or other intellectual property rights, or rights of publicity or privacy.
      • violates, or encourages any conduct that would violate, any applicable law or regulation or would give rise to civil liability.
      • is fraudulent, false, misleading or deceptive.
      • is defamatory, obscene, pornographic, vulgar or offensive.
      • promotes discrimination, bigotry, racism, hatred, harassment or harm against any individual or group.
      • is violent or threatening or promotes violence or actions that are threatening to any other person.
      • promotes illegal or harmful activities or substances.
    • systematically retrieve data or other content from our Site or Services to create or compile, directly or indirectly, in single or multiple downloads, a collection, compilation, database, directory or the like, whether by manual methods, through the use of bots, crawlers, or spiders, or otherwise.
    • The Platform reserves the right, at any time and without prior notice, to remove or disable access to any Collective Content that we, at its sole discretion, consider to be objectionable for any reason, in violation of these Terms or otherwise harmful to the Site or Services.

    Ownership

    The Site, Services, and Collective Content are protected by copyright, trademark, and other laws of Sweden and foreign countries. You acknowledge and agree that the Site, Services and Collective Content, including all associated intellectual property rights is the exclusive property of the Platform and its licensors.

    You will not remove, alter or obscure any copyright, trademark, service mark or other proprietary rights notices incorporated in or accompanying the Site, Services, or Collective Content.

    The Platform Content and Member Content License

    Subject to your compliance with the terms and conditions of these Terms, the Platform grants you a limited, non-exclusive, non-transferable license, to (i) access and view any the Platform Content and (ii) access and view any Member Content to which you are permitted access. You have no right to sublicense the license rights granted in this section.

    You will not use, copy, adapt, modify, prepare derivative works based upon, distribute, license, sell, transfer, publicly display, publicly perform, transmit, broadcast or otherwise exploit the Site, Services, or Collective Content, except as expressly permitted in these Terms.

    No licenses or rights are granted to you by implication or otherwise under any intellectual property rights owned or controlled by the Platform or its licensors, except for the licenses and rights expressly granted in these Terms.

    Member Content

    We permit Artists to post, upload, publish, submit or transmit Member Content. By making available any Member Content on or through the Site and Services, you hereby grant to the Platform a worldwide, irrevocable, perpetual, non-exclusive, transferable, royalty-free license, with the right to sublicense, to use, view, copy, adapt, modify, distribute, license, sell, transfer, publicly display, publicly perform, transmit, stream, broadcast, access, view, and otherwise exploit such Member Content on, through, or by means of the Site and Services.

    The Artist agrees to grant a royalty free, worldwide, irrevocable, non-exculive licence to the Customer to use any images in accordance with the package bought by the Customer via the Site.

    The Customer agrees to pay for any image rights via the Site using Stripe.

    The Platform shall act like the Artist’s third party payment processor and shall forward the fees from the Customer to the Artist less a percentage fee for the Services.

    The Platform does not claim any ownership rights in any such Member Content and nothing in these Terms will be deemed to restrict any rights that you may have to use and exploit any such Member Content.

    You acknowledge and agree that you are solely responsible for all Member Content that you make available through the Site and Services. Accordingly, you represent and warrant that: (i) you either are the sole and exclusive owner of all Member Content that you make available through the Site and Services or you have all rights, licenses, consents and releases that are necessary to grant to the Platform the rights in such Member Content, as contemplated under these Terms; and (ii) neither the Member Content nor your posting, uploading, publication, submission or transmittal of the Member Content (or any portion thereof) on, through or by means of the Site and the Services will infringe, misappropriate or violate a third party’s patent, copyright, trademark, trade secret, moral rights or other proprietary or intellectual property rights, or rights of publicity or privacy, or result in the violation of any applicable law or regulation.

    Intellectual Property

    All trademarks, service marks, logos, trade names and any other proprietary designations of the Platform used herein are our trade marks or registered trade marks. Any other trademarks, service marks, logos, trade names and any other proprietary designations are the trademarks or registered trademarks of their respective parties.

    The Platform respects copyright law and expects its users to do the same. It is our policy to terminate in appropriate circumstances the Platform Accounts of Members or other account holders who infringe or are believed to be infringing the rights of copyright holders.

    Termination and the Platform Account Cancellation

    We may, at our discretion and without liability to you, with or without cause, with or without prior notice and at any time: (a) terminate these Terms or your access to our Site and Services, and (b) deactivate or cancel your Platform Account.

    In the event the Platform terminates these Terms, or your access to our Site and Services or deactivates or cancels your Platform Account you will remain liable for all amounts due hereunder.

    Limitation of Liability

    You acknowledge and agree that, to the extent permitted by law, the entire risk arising out of your access to and use of the Site, Services and Collective Content, via the Site and Services and any contact you have with other users of the Platform remains with you.

    Neither the Platform nor any other party involved in creating, producing, or delivering the Site, Services or Collective Content will be held liable for any loss or damage arising in any way from your use of the Site, Services or Collective Content.

    Indemnity

    You agree to release, defend, indemnify, and hold the Platform and its affiliates and subsidiaries, and their officers, directors, employees and agents, harmless from and against any claims, liabilities, damages, losses, and expenses, including, without limitation, reasonable legal and accounting fees, arising out of or in any way connected with (a) your access to or use of the Site, Services, or Collective Content or your violation of these Terms; (b) your Member Content; and (c) your use of the Services, including, but not limited to any injuries, losses, or damages (compensatory, direct, incidental, consequential or otherwise) of any kind arising in connection with or as a result of a booking.

    Assignment

    You may not assign or transfer these Terms, by operation of law or otherwise. the Platform may assign or transfer these Terms, at its sole discretion, without restriction. Subject to the foregoing, these Terms will bind and inure to the benefit of the parties, their successors and permitted assigns.

    Notices

    Any notices or other communications permitted or required hereunder, including those regarding modifications to these Terms, will be posted to the Site. For notices made by e-mail, the date of receipt will be deemed the date on which such notice is transmitted.

    Governing Law

    These Terms shall be governed by and interpreted in accordance with the laws of Sweden. You and we agree to submit to the exclusive jurisdiction of the courts of Sweden for all disputes arising from the use of the Site.

    General

    The failure of the Platform to enforce any right or provision of these Terms will not constitute a waiver of future enforcement of that right or provision. The waiver of any such right or provision will be effective only if in writing and signed by our duly authorised representative. Except as expressly set forth in these Terms, the exercise by either party of any of its remedies under these Terms will be without prejudice to its other remedies under these Terms or otherwise.

    If for any reason an arbitrator or a court of competent jurisdiction finds any provision of these Terms invalid or unenforceable, that provision will be enforced to the maximum extent permissible and the other provisions of these Terms will remain in full force and effect.

    If any provision of this Agreement is held to be invalid or unenforceable, such provision will be severed and the remaining provisions shall remain in effect.

    If you choose to use the Site, and Services, you do so at your sole risk. The Site, Services, and Collective Content are provided on an “as is” basis, without warranty of any kind, either express or implied besides those implied at law.

    We make no warranty that the Site, Services, Collective Content, will meet your requirements or be available on an uninterrupted, secure, or error-free basis.

    We make no warranty regarding the Services or Collective Content or the accuracy, timeliness, truthfulness, completeness or reliability of any Collective Content obtained through the Site, or Services.

    No advice or information, whether oral or written, obtained from the Platform or through the Site, Services or Collective Content, will create any warranty not expressly made herein.

    Google Analytics

    Google Analytics is a web analytics service offered by Google that tracks and reports website traffic. Google uses the data collected to track and monitor the use of our Services.     You can opt-out of having made your activity on the Services available to Google Analytics by installing the Google Analytics opt-out browser add-on. We reserve the right to confirm your California residence to process your requests and will need to confirm your identity to process your requests to exercise your information, access or deletion rights. As part of this process, government identification may be required. Consistent with California law, you may designate an authorized agent to make a request on your behalf. In order to designate an authorized agent to make a request on your behalf, you must provide a valid power of attorney, the requester’s valid government-issued identification, and the authorized agent’s valid government issued identification. We cannot process your request if you do not provide us with sufficient detail to allow us to understand and respond to it.
    • Request a list of third party marketers.California’s “Shine the Light” law (California Civil Code § 1798.83) allows California residents to ask companies with whom they have formed a business relationship primarily for personal, family or household purposes to provide certain information about the companies’ sharing of certain personal information with third parties for their direct marketing purposes during the preceding year (if any). You can submit such a request by sending an email to support@ayewind.com with “Shine the Light” in the subject line. The request must include your current name, street address, city, state, and zip code and attest to the fact that you are a California resident.

    We cannot process your request if you do not provide us with sufficient detail to allow us to understand and respond to it.

    We do not sell, trade, or rent Users personal identification information to others in accordance with the CCPA. We may share generic aggregated demographic information not linked to any personal identification information regarding visitors and users with our business partners, trusted affiliates and advertisers for the purposes outlined above.
